Silver was asked about that, he said "In meting out this punishment we did not take into account his past behavior. When the board ultimately considers his overall fitness to be an owner in the NBA, they will take into account a lifetime of behavior." So the lifetime ban is apparently based only on this one incident.

Which I can understand too. The racist guy saqid he had a problem with his GF posting a pcture of herself with Magic Johnson to Instagram for racist reasons.

Huge fight coming on over teh ownership issue

I think the Commisioner jumped the gun without thinking the thing through. I heard this morning that Sterling and his wife own the team. Raises a bunch of questions....
Is the NBA going to strip her of her ownership interest as well?
Can the NBA sever the ownership interests?
Can the NBA force the new ownership group to become partners with the wife?
Can the NBA preclude the transfer of the team to the wife?
Who values the franchise, and what happens when there is a dispute as to ownership?
Do they arbitrate the case or go to the Beach in Delaware to litigate in G'town?
Who decides in the future what constitutes an offense that brings about the nuclear option? This year its racism, next it may be gay issues and any non support for gay marriange. Next could be muslim, or not anti-Isreal enough.


On top of everything, I am not sure I am overly comfortable with a league taking the property of someone over thoughts and conversations that occurred in hi sown home, no matter how repugnant.

What about a lawsuit accusing the league of diminishing the re-sale value of his franchise because he will be perceived to be selling under duress?

I could see all sorts of avenues for litigation if he want to enhance his reputation as a douchebag.

I thought this was quite good in addressing potential legal issues. Basically, Silver is on very firm footing with the fine and suspension, but attempting to force a sale could be very perilous for the NBA.
