and Penn State. (However, a majority of the PSU board and nine elected trustees pushed to join the plaintiff).

I'm guessing that many of us thought the NCAA freely decided to restore Paterno's wins, but with a lawsuit trial pending, the NCAA had to compromise with the state of Pennsylvania. I imagine PSU and its trustee are delighted with this outcome despite being a errrr defendant.
