Right so if his intent wasn't to help aid his capture (like I wasn't sure if it was coordinated with authorities) then he essentially harbored a fugitive and let him walk away. Maybe not technically illegal (I have no idea) but pretty disgraceful.

I do not think he was in on it with the authorities and I'm not sure he has First Amendment protection as a "journalist" but, as I read elsewhere and from reading Penn's blathering in the article about the evils of law enforcement (my words), at best he glorified a fucking murderer.
